Date: 20 November 2006 UPDATED INFORMATION ON THE CASE OF THE JOURNALIST MR ZORAN BOZINOVSKI
Dear Sir/Madam
We are writing to inform you on the latest development of the case of the prominent Macedonian journalist Mr. Zoran Bozinovski, updating our previous information of 26 May 2006. On 22 May Mr Bozinovski was summoned to a penitentiary institution to serve imprisonment sentence, even though on 10 May the Macedonian Parliament abolished the imprisonment as a means of punishment of journalists for offences in performing their profession. According to the provisions of the Criminal Code [then and now], retroactive application of criminal law is prohibited, unless it is more favourable to the person (emphasized by CSRC). In spite of legal remedies lodged by Mr Bozinovski, the authorities continued their efforts to imprison Mr Bozinovski. On 18 November 2006, while sitting in a restaurant together with another person (a Member of the Parliament), an officer of the "Alfa" special police forces (a police unit in charge of dealing with violent crime on the streets!) asked/forced him to go to the prison to serve the sentence. From 18 November 2006 up to day Mr Bozinovski has been imprisoned in the "Shutka" prison, where he shares a cell with no less than 6 other people, and, reportedly, there are no basic facilities for normal and dignified imprisonment. Due to lack of beds he has to sleep on the floor, which is very cold because of lack of heating, and there is a limited access to water. CSRC believes that sending Mr Bozinovski to prison is contrary to the relevant freedom of information standards and threatens the freedom of press. Thus, tomorrow (21 November) 11:00 AM in the NGO Info center / NVO Info centar (Gradski dzid, blok 8, Skopje) we will organize a press conference and invite those who are able and willing to attend it.
